Terms & Conditions
These Terms & Conditions (“Terms”) govern all services provided by Endurance Works. By booking, purchasing, or participating in testing, assessments, or consultations, you agree to these Terms.
1. Booking, Payment & Packages

Bookings are confirmed only upon receipt of full payment or, where applicable, an agreed deposit.

Payment may be made online, by bank transfer, or in any other method specified by Endurance Works.

Packages, prepaid sessions, and gift vouchers are valid for 12 months from purchase and are non-transferable unless agreed in writing.

Expired vouchers, sessions, or packages will not be refunded.
2. Cancellation, Rescheduling & Refunds

A minimum of 24 hours’ notice is required to cancel or reschedule a session.
-
Cancellations within 24 hours will be charged at the full session rate.

Refunds (where eligible) will be made to the original payment method within 14 business days.

Endurance Works reserves the right to reschedule or cancel sessions in exceptional circumstances. In such cases, you will be offered either:

a full refund, or
-
the option to reschedule without penalty.

3. Late Arrival & Missed Sessions

Please arrive punctually. Testing requires preparation and calibration time, and delays may affect results.

On-site testing: A 15-minute grace period applies. Sessions starting late may be shortened without discount or may be cancelled at full charge.

Mobile/off-site testing: A 15-minute grace period applies. If late, we may be unable to complete testing due to time or venue restrictions, and the session may be charged in full.
4. Client Health, Safety & Responsibility

By booking, you confirm that you are in good health and medically fit to undertake testing, exercise assessments, and physical activity.

It is your responsibility to seek medical advice before engaging in services if you have any health concerns.

You must inform us of all relevant medical conditions, injuries, medications, or allergies before testing begins.

Clients under 18 years of age must be accompanied by a parent or legal guardian, who must consent to testing.

You agree to follow all instructions provided by Endurance Works staff to ensure your safety.
5. Risks & Liability

Physiological testing and exercise assessments carry inherent risks. By participating, you acknowledge these risks and accept personal responsibility.

Endurance Works is not liable for:
-
Injuries, illness, or adverse events arising during or after testing.
-
Loss, theft, or damage to personal belongings.
-
Results impacted by client actions (e.g., poor preparation, illness, inadequate sleep, improper nutrition).

Recommendations, reports, and training advice provided are for educational and informational purposes only and do not replace professional medical advice.
6. Equipment, Facilities & Environment

Endurance Works will provide testing equipment that is maintained, calibrated, and operated to a high standard.

Clients or host venues must ensure testing environments are safe, clean, and suitable (including sufficient space, ventilation, and access to power if required).

Endurance Works is not responsible for interruptions, delays, or cancellations due to venue issues, weather, or technical failures outside our control.

Any damage to Endurance Works equipment caused by negligence may result in repair or replacement costs being charged.
7. Call-Outs, Travel & Fees

Mobile testing may include a call-out fee and mileage charge. This will be agreed at the time of booking.

Parking charges, tolls, or access fees (if applicable) are the responsibility of the client or host venue.
8. Data Protection & Privacy

Endurance Works is registered with the ICO (No. ZB952896) and complies with the UK GDPR and Data Protection Act 2018.
-
We collect and store personal and physiological data solely for the purpose of delivering testing and performance analysis.
-
Data will not be shared with third parties without consent, except where required by law.
-
Clients may request a copy or deletion of their data at any time.
-
Reports and analysis are confidential and provided only to the paying client unless written consent is given to share with third parties (e.g., coaches, nutritionists, physiotherapists).
9. Use of Test Results & Intellectual Property

Test results, reports, and recommendations are for personal use only.
-
They may not be copied, reproduced, distributed, or used for commercial purposes without prior written permission.

Endurance Works retains intellectual property rights to all methodologies, testing protocols, and proprietary data collection systems.
10. Limitations & Disclaimers

Test results are influenced by factors such as client preparation, environment, and natural physiological variation. Endurance Works does not guarantee specific outcomes.

Services are provided on an “as is” basis. While we strive for accuracy, results should not be regarded as medical diagnoses.

Endurance Works does not accept responsibility for performance outcomes in training or competition.
11. Force Majeure

Endurance Works is not liable for cancellations, delays, or changes caused by events outside our reasonable control, including but not limited to:
-
Adverse weather, transport disruption, or venue closure.
-
Illness or injury of staff.
-
Power outages, technical failures, or equipment breakdowns.
-
12. Governing Law
-
These Terms are governed by and construed in accordance with the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the English courts.
